Terms and Conditions of the Instagram Competition

 1.⁠ ⁠ORGANISER AND DURATION OF THE COMPETITION

The competition is organised by Biogas Service Tarmstedt, Am Falkenlager 15-17, 27412 Tarmstedt (hereinafter referred to as the “Organiser”). It begins on 3 July 2026 at 10:00 and ends on 15 July 2026 at 23:59. The competition is not affiliated with Instagram or any of its affiliated companies.

 2.⁠ ⁠ACCEPTANCE OF THE TERMS AND CONDITIONS OF PARTICIPATION

To take part in the competition, the following conditions must be met: Participants must follow the channel and, in the comments, estimate the size of the warehouse shown in the video. For the entry to be valid, the estimate must be submitted.

 3.⁠ ⁠ELIGIBILITY

All persons aged 18 or over are eligible to take part. Multiple entries are not permitted. Employees of the organiser and their family members are also excluded from taking part.

 4.⁠ ⁠PRIZE

The following prize is up for grabs: a voucher worth £50.00

 5.⁠ ⁠ENTRY DETAILS

Entry to the competition is free of charge and takes place exclusively online. All persons who provide the correct answer in the comments section below the competition post from the start of the promotion will be entered into the competition. The winner will be selected by the organiser via a random draw and notified in writing via Instagram by 17 July 2026.

 6.⁠ ⁠LEGAL REMEDIES

No legal action may be taken regarding the determination of the winner. No correspondence will be entered into regarding the competition. The competition and these terms and conditions are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Tostedt.

 7.⁠ ⁠CONDUCT OF THE COMPETITION

The prize cannot be paid out in cash, in kind, exchanged or transferred to other persons. The winner may decline the prize. In this case, another participant will be selected. To this end, so-called ‘standby places’ are identified during the first draw, which will be called upon in the event of a winner declining the prize. The redemption of the prize will be arranged individually with the respective winner. The winner will be notified in writing via Instagram by 17 July 2026 at 18:00 and asked to confirm their acceptance. If the organiser does not receive written confirmation within three days of the request being sent, the prize will be forfeited. Should the contact details provided be incorrect (e.g. an incorrect address), the organiser is under no obligation to trace the correct address. The announcement of the winner is subject to change.

 8.⁠ ⁠EARLY TERMINATION, EXCLUSION OF LIABILITY AND DATA PROTECTION

The organiser wishes to point out that the availability and proper functioning of the competition cannot be guaranteed. The organiser is entitled to terminate the competition early if its continuation can no longer be guaranteed for technical and/or legal reasons. Such reasons may include, for example, technical problems (viruses in the computer system, tampering, faults in the hardware and/or software, etc.), changes to the terms and conditions of use, or other decisions. Participants shall have no claims arising from the early termination.

 9.⁠ ⁠LIABILITY

Without prejudice to other statutory conditions for claims, the following exclusions and limitations of liability apply to the organiser’s liability for damages.

a. The organiser shall be liable without limitation where the cause of the damage is attributable to wilful misconduct or gross negligence.

b. Furthermore, the organiser shall be liable for the breach, through slight negligence, of essential obligations, the breach of which jeopardises the fulfilment of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper conduct of the competition and on the observance of which the contracting parties regularly rely. In such cases, however, the organiser shall only be liable for foreseeable damage typical of this type of contract. The organiser shall not be liable for the breach, through slight negligence, of any obligations other than those mentioned in the preceding sentences.

c. The above limitations of liability shall not apply in the event of injury to life, limb or health; in the case of a defect following the assumption of guarantees as to the quality of a product; or in the case of defects fraudulently concealed. Liability under the Product Liability Act remains unaffected.

d. Insofar as the organiser’s liability is excluded or limited, this also applies to the personal liability of the organiser’s employees, representatives and vicarious agents.

10.⁠ ⁠PRIVACY NOTICE
